Elder Law Services and Estate Dispute Mediation
We can’t fix or prevent aging, but we can help families manage their stress and make the most of their remaining time together, while preserving the future relationships of surviving loved ones.
At TKW Mediation and Planning, we take a forward-looking approach to the difficult decisions surrounding eldercare by helping families navigate the complex legal, medical, and financial issues that arise with aging. While caring for an aging parent or loved one can be a deeply meaningful experience, it can also be emotionally and physically challenging, particularly when family conflicts emerge. Our family-focused and holistic approach to eldercare planning incorporates the wishes of the aging individual as well as the needs of their families. We collaborate with seniors and families to facilitate difficult conversations and develop specialized, flexible plans that address the unique needs and circumstances of each situation.
Our services include:
Eldercare Mediation
Estate Dispute Mediation

Eldercare Mediation
Eldercare mediation is a constructive way for families and loved ones to address the legal, health, logistical, and emotional challenges that come with aging. In this process, a neutral third-party mediator works with families to facilitate communication, helping families collaborate on mutually agreeable solutions. Mediators can also play a vital role in preventing future disputes by working with families proactively to create care plans and document the wishes of aging individuals.
Mediators are particularly effective in resolving conflicts related to end-of-life care and establishing a consensus on care responsibilities among family members. Common issues addressed during eldercare mediation include:
What is the best living arrangement for a parent or loved one?
What kind of care is needed, and who will provide it?
Who is responsible for coordinating and managing care?
How will their care be financed?
Who is responsible for responding to acute issues that arise?
When should they stop driving, accept in-home assistance, or transition into assisted living?
Who should hold financial or medical power of attorney, and what events will trigger it?
Estate Dispute Mediation
Estate disputes that arise after a parent or loved one passes can be emotionally exhausting and financially draining and can fracture family relationships. These conflicts are often fueled by complex, non-legal issues rooted in years of family history. While courts can make decisions about asset distribution, estate disputes involve emotional factors that cannot be adequately addressed in court. Estate dispute mediation is a cost-effective way of resolving these disputes while preserving family ties. An experienced mediator works with families to identify and address the underlying issues driving the disputes, empowering them to work together toward positive outcomes.
The best way to prevent estate disputes is for parents to plan ahead and communicate openly with their adult children about their estate plans. While these conversations can be challenging—especially if parents anticipate that their plans may upset one or more of their children—initiating them in advance can strengthen family relationships and minimize the risk of future litigation and sibling conflicts. At TKW, we assist families in navigating these difficult conversations. Although we are not estate planners, we help families develop distribution plans that support the unique emotional and financial needs of the surviving children.
